3. Use of Website
3.1 Acceptable Use

4. Equipment Hire Services
4.1 Quotations and Bookings
- All quotations are valid for 30 days unless otherwise stated
- Quotations are not binding until we issue a written confirmation of hire
- Prices are subject to change without notice until booking is confirmed
- A booking is only confirmed upon receipt of our written confirmation
4.2 Hire Rates and Payment Terms
- Hire rates are calculated on a daily, weekly, or monthly basis as specified
- Hire charges commence from the time equipment leaves our premises
- Payment terms are strictly net 30 days from invoice date unless otherwise agreed
- We reserve the right to charge interest on overdue accounts at a rate of 2% per month
- A deposit may be required for certain equipment or first-time customers
- All prices quoted are exclusive of VAT unless otherwise stated
4.3 Delivery and Collection
- Delivery and collection charges are additional to hire rates unless otherwise agreed
- Delivery times are estimates and we are not liable for delays beyond our reasonable control
- The Customer must ensure safe access for delivery and collection vehicles
- The Customer is responsible for providing adequate unloading facilities
- Risk in the equipment passes to the Customer upon delivery
4.4 Hire Period
- The hire period begins when equipment leaves our premises and ends when it is returned to us
- Equipment must be returned on or before the agreed return date
- If equipment is not returned by the agreed date, hire charges will continue to accrue
- We reserve the right to collect equipment if the hire agreement is breached
4.5 Minimum Hire Period
- Minimum hire periods may apply to certain equipment
- Even if equipment is returned early, charges for the minimum hire period still apply
5. Customer Responsibilities
5.1 Equipment Care
The Customer agrees to:
- Use equipment in a proper, safe, and lawful manner
- Use equipment only for its intended purpose
- Follow all manufacturer's instructions and safety guidelines
- Keep equipment in their custody and not sub-hire without written permission
- Protect equipment from damage, theft, and adverse weather conditions
- Maintain equipment in good working order during the hire period
- Carry out daily checks and routine maintenance as instructed
- Report any defects or damage immediately
- Not make any modifications or repairs to equipment without our written consent
5.2 Operator Competency
The Customer warrants that:
- All operators are suitably qualified, trained, and competent
- All necessary certifications and licences are current and valid
- Operators will comply with all health and safety legislation
- Appropriate personal protective equipment (PPE) will be used
5.3 Insurance
The Customer is responsible for:
- Insuring equipment against all risks during the hire period
- Providing proof of insurance upon request
6. Damage, Loss, and Liability
6.1 Customer Liability
The Customer is liable for:
- All damage to equipment during the hire period, regardless of cause
- Loss or theft of equipment
- The full replacement cost if equipment is damaged beyond economic repair
- All consequential losses arising from damage, loss, or theft
- Cleaning charges if equipment is returned in an unacceptable condition
6.2 Inspection
- Equipment is inspected before and after hire
- The Customer should inspect equipment upon delivery and report any issues immediately
- Equipment is deemed to be in good working order unless notified within 24 hours of delivery
6.3 Our Liability
To the maximum extent permitted by Irish law:
- We are not liable for any indirect, consequential, or special losses
- Our total liability shall not exceed the hire charges paid for the relevant equipment
- We are not liable for delays, breakdowns, or equipment unsuitability unless due to our negligence
- We do not exclude liability for death or personal injury caused by our negligence
7. Cancellation and Returns
7.1 Cancellation by Customer
- Cancellations must be made in writing
- Cancellations made less than 48 hours before delivery may incur a cancellation charge
- Deposits paid are non-refundable upon cancellation
7.2 Early Return
- Early return of equipment does not entitle the Customer to a refund
- Minimum hire period charges still apply
7.3 Our Right to Terminate
We reserve the right to terminate a hire agreement immediately if:
- Payment terms are breached
- Equipment is being misused or damaged
- The Customer breaches these Terms
- We reasonably believe equipment is at risk
8. Health and Safety
8.1 Compliance
The Customer must comply with:
- Health and Safety Authority regulations
- All relevant Irish health and safety legislation
- Industry best practices and codes of conduct
- Site-specific safety requirements
8.2 Risk Assessment
The Customer is responsible for conducting appropriate risk assessments before using equipment.
8.3 Incidents
The Customer must immediately report any accidents, injuries, or dangerous occurrences involving our equipment.
9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, industrial disputes, fire, flood, storm, or failure of suppliers.
10. Data Protection
We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for full details.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the Irish courts.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
